Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the date,

  • on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are or will be delivered uniformly, or
  • on which you or a third party named by you, who is not the carrier, have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately, or
  • on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, if you have ordered goods that are delivered in several partial shipments or pieces, or
  • on which you or a third party named by you, who is not the carrier, have taken possession of the first goods, provided that you have concluded a contract for the regular delivery of goods over a fixed period of time.

To exercise your right of withdrawal, you must inform us (Küsten Jungle, Max Kucher, Mojweg 14, 27639 Wurster Nordseeküste, Germany, telephone number: 01772833171, email address: info@kuesten-jungle.de) inform us of your decision to revoke this contract by means of a clear statement (e.g., a letter or email sent by post). You may use the attached sample revocation form for this purpose, although it is not mandatory.

Alternatively, you can exercise your right of withdrawal via our electronic withdrawal function. This can be accessed on our website at the following link: Cancel contract. The cancellation function is available to you for the entire cancellation period.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of revocation

If you revoke this contract, we shall repay you all payments that we have received from you (with the exception of delivery costs in the event of partial revocation or express surcharges), immediately and at the latest within fourteen days from the day on which the notification of your revocation of this contract is received by us. We will use the same means of payment for this repayment that you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged fees for this repayment.

We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You must compensate for any loss in value of the goods if this loss in value is due to handling the goods in a manner not necessary for testing their condition, characteristics, and functionality.

Since our products are live plants, we ask that you pack them carefully and professionally. Plants must be adequately protected from pressure, cold, and heat – similar to the original packaging. In the event of improper packaging or transport outside of suitable temperature conditions, we may deduct a reasonable compensation for damages according to § 357 Paragraph 7 of the German Civil Code (BGB), insofar as the depreciation is attributable to unnecessary handling of the goods.
